General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed through our online store. Our online store is exclusively intended for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the course of their commercial or independent professional activity when entering into a legal transaction.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with SUCCESS AND MORE GmbH.

By placing products in the online store, we make a binding offer to conclude a contract for the purchase of these items. You can initially place our products in the shopping cart without any obligation and can correct your entries at any time before submitting your binding order by using the correction tools provided during the order process. The contract is concluded by clicking the order button, thereby accepting the offer for the goods in the shopping cart. Immediately after submitting the order, you will receive a confirmation via email.

3. Contract Language, Contract Text Storage

The available language(s) for the conclusion of the contract: German

We store the contract text and send you the order data and our GTC in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Conditions

The product prices indicated are exclusive of shipping costs. More details about the shipping costs can be found in the offers or the shipping information.

We only deliver via shipping. Unfortunately, self-collection of the goods is not possible.

The delivery time is specified for each item on the product page.

If no delivery time is indicated, our general delivery times apply, which can be found in the shipping information.

Please note that we are not obligated to deliver the ordered goods if we have properly ordered the goods from our side but were not supplied correctly or on time (congruent covering transaction). We are also not responsible for the procurement of the ordered goods.

If tracking shows that your shipment has been delivered but you have not received the goods, please contact us within three days after the indicated delivery date. This period must be observed in order to take further action. Additional details are provided in our FAQs.

If your order cannot be delivered for reasons not under our control, is refused, or not picked up from the parcel station/shop, it will be returned to us. In such cases, this will be treated as a cancellation, and the contract will be automatically converted into a reverse transaction. We will refund the paid items minus any additional costs (e.g., shipping €4.00 to €6.90).

5. Payment

The following payment methods are available in our shop:

Credit Card
During the order process, you provide your credit card details. Your card will be charged immediately after placing the order.

PayPal
To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate with your login details, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order.

Sofort by Klarna
To pay via Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order.

Google Pay
To pay via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have Google Pay enabled, authenticate with your login details, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order.

Apple Pay
To pay via Amazon Payments Europe S.C.A., 38 avenue J.F. Kennedy, L-1855 Luxembourg (“Amazon”), you must be registered with Amazon, authenticate with your login details, and confirm the payment instruction. The payment transaction is carried out within one business day after placing the order.

Amazon Pay
To pay via Amazon Payments Europe S.C.A., 38 avenue J.F. Kennedy, L-1855 Luxembourg (“Amazon”), you must be registered with Amazon, authenticate with your login details, and confirm the payment instruction. The payment transaction is carried out within one business day after placing the order.

Klarna
In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer the following payment options. Payment via Klarna is only available to consumers. If not otherwise stated, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information will be provided during the payment process.

Im Bestellprozess geben Sie Ihre Kreditkartendaten an. Ihre Karte wird durch Klarna unmittelbar nach Abgabe der Bestellung belastet. Eine Adress- und Bonitätsprüfung findet nicht statt.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Warranty and Guarantees​​​​​​​

Legal warranty rights apply.

Unless explicitly stated otherwise, the statutory warranty rights apply. The following limitations and shorter periods do not apply to claims for damages caused by us, our legal representatives, or agents due to:

  • Injury to life, body, or health
  • Intentional or grossly negligent breach of duty or fraudulent behavior
  • Violation of essential contract obligations
  • In the case of a guarantee promise, if agreed
  • If the Product Liability Act applies.

Limitations for Consumers

For the purchase of used goods by consumers, if a defect occurs more than a year after delivery of the goods, warranty claims are excluded. Defects occurring within one year of delivery of the goods can be asserted within the statutory limitation period of two years from the delivery of the goods.

Guarantees and Customer Service

Information on any applicable additional guarantees and their specific terms can be found for each product and on special information pages in the online shop.

8. Liability

We are fully liable for claims based on damages caused by us, our legal representatives, or agents in the case of:

  • Injury to life, body, or health
  • Intentional or grossly negligent breach of duty
  • Warranty promises, if agreed
  • If the Product Liability Act applies.

For breach of essential contract obligations (cardinal obligations) caused by slight negligence by us, our legal representatives, or agents, liability is limited to the foreseeable damage that typically occurs.

9. Dispute Resolution​​​​​​​

The European Commission provides a platform for online dispute resolution (ODR), which you can find. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Complaints/Wrong Deliveries

If you receive a damaged or incorrect item, please contact us within three days after the indicated delivery date. Prior contact is required for a return. This deadline must be adhered to in order to proceed with the next steps. Please use our return portal for complaint or wrong delivery registration. More details are available in our FAQs.

11. Shipping Damages

If you receive goods with visible shipping damage, please immediately file a complaint with the carrier, document the damage with photos, and contact us within three days. Failure to meet the deadline will result in us being unable to claim the damages from the shipping service provider, and you will not be reimbursed for the costs. The process is described in more detail in our FAQs.

12. Gift Cards

A correct email address is required for the delivery of the gift card.

We are not liable for the loss of the gift card.

The Pummys™ voucher can be used until fully redeemed, and the balance will not be refunded or earn interest.

If you return goods purchased with a gift card, the purchase price will be credited back to the voucher.

By purchasing and/or using the gift card, you agree to the terms and conditions provided with the gift card.

13. Discount Codes

Each customer can apply the corresponding discount code only once per purchase.

Each discount code can only be used once per customer, and discount codes cannot be combined. Only one discount code can be used per order.

It is not possible to apply a discount code to a completed order after submission.

In case of return or cancellation, only the discounted purchase price will be refunded. There is no entitlement to refund of the discount code or the issuance of a new discount code.

14. Right of Withdrawal

If worn, damaged, or non-customer items are returned and the return is refused, the customer has 7 days to respond to the refusal email. Via a link in the refusal email, the customer can upload a shipping label within 7 days to return the refused items. If no response or label is received within this period, the items will be donated.
